Non-Representation Legal Form Services Agreement
1. Offer and Eligibility
1.1 Promotion.
From time to time, Valentino Law PLLC (the โLaw Officeโ) may advertise a promotion for one free Simple Will. To request the free Simple Will during a live promotion, the client must respond using the designated promotion keyword and the channel stated in that promotion. The Law Office may limit any promotion by time, geography, or quantity, and may end any promotion at any time.
1.2 Eligibility. The โClientโ affirms the Client is at least 18, of sound mind, acting voluntarily without undue influence, and understands Floridaโs execution rules for wills in Fla. Stat. ยง 732.502.
2. ScopeโScrivener Services Only; No Legal Representation or Advice
2.1 Neutral scrivener. Under this free promotion, the Law Officeโs role is limited to transcribing Client-supplied information into a basic Simple Will as defined in Section 3. The Law Office does not provide legal advice or legal opinions, and does not analyze Client facts under applicable law within this free scope. No attorney-client relationship is formed by participating in the free promotion.
2.2 Prospective client confidentiality. Although no attorney-client relationship is formed, the Law Office will treat information provided during intake as confidential to the extent required by Florida Rule 4-1.18 (Prospective Clients).
2.3 Out-of-scope representation. Any legal advice, broader estate planning, probate representation, or customization beyond the Simple Will is outside this free scope and requires a separate signed engagement agreement and fees.
3. What Counts as a โSimple Willโ Under This Offer
3.1 Distribution mechanics. One (1) primary beneficiary receives 100% of the residuary estate, outright and free of trust. One (1) alternate beneficiary receives 100% if the primary beneficiary does not survive the testator.
3.2 Express exclusions. A Simple Will does not include: designation of a personal representative; any specific gifts or bequests; multiple or fractional residuary shares; per stirpes or per capita provisions; any testamentary trust (including special needs/spendthrift); guardianship provisions; charitable gifts; pet provisions; digital-asset instructions; funeral instructions; tax-planning clauses; homestead carve-outs; business-succession terms; provisions for foreign property; electronic or remote execution arrangements; or other customized drafting.
3.3 Florida rights that can override a will. The Client acknowledges that Florida homestead restrictions and the spousal elective share can supersede dispositions, even under a simple plan. See Fla. Stat. ยง 732.4015 (homestead devise limitations) and ยงยง 732.201 & 732.2065 (surviving spouse elective share).
4. Requests Beyond โSimpleโโTriage, Quotes, and Attorney Teleconference
4.1 Firm discretion. If the Client requests terms beyond Section 3, the Law Office will determine, in its sole discretion, whether the request still qualifies as โSimple.โ
4.2 Quotes & process. If not Simple, the Law Office may provide a written fee quote to add the requested terms or may offer to schedule a teleconference with an attorney to discuss paid services. No fees are incurred unless the Client accepts a written quote.
4.3 Initial communication. Non-lawyer staff may contact the Client to clarify factual information needed to populate the form, without providing legal advice. If legal advice is requested or appears necessary, a teleconference with an attorney can be scheduled as described above.
4.4 Conflicts. The Law Office will conduct a limited conflicts screen for the scrivener service. A full conflicts check applies if the Client seeks paid legal representation.
5. Execution, Self-Proof, and Client Responsibility
5.1 Clientโs responsibility for signing. The Law Office will provide written instructions for proper execution. The Client is solely responsible for arranging execution and preserving the original. Florida requires a will to be in writing, signed at the end by the testator, and executed in the presence of two attesting witnesses who sign in the presence of the testator and each other. See ยง 732.502.
5.2 Self-proving affidavit. To streamline probate, execution should be conducted before a notary public using a self-proving affidavit compliant with ยง 732.503.
5.3 No witnesses/notary provided. Under the free promotion, the Law Office does not provide witnesses or notarial services, and does not supervise execution.
6. Important Legal Effects and Limitations
6.1 Homestead and spousal rights. Florida homestead devise restrictions and the spouseโs elective share can override will terms. The Client should seek legal advice if these apply.
6.2 No tax/Medicaid/creditor advice. This free service provides no advice regarding taxes, creditor issues, asset protection, or Medicaid planning.
6.3 No warranty as to client-supplied facts. The Law Office relies on information provided by the Client and makes no warranty as to the accuracy or legal sufficiency of that information.
7. Client Duties
7.1 Accurate information. The Client must provide full legal names and the relationship to the Client for the one primary and one alternate beneficiary.
7.2 Review. The Client must review the draft for accuracy, including names, relationships, and disposition. One round of clerical corrections is included. Substantive changes may require a fee under Section 4.
7.3 Execution & storage. The Client must execute the will properly and store the original safely. The Law Office is not in the regular practice of retaining original wills.
7.4 Identity & fraud prevention. The Client agrees to provide reasonable proof of identity upon request and acknowledges the Law Office may refuse service where identity, capacity, or undue-influence concerns arise.
8. Deliverables and Records
8.1 Delivery format. The Law Office delivers the final Simple Will in PDF for printing and signature.
8.2 Record retention. The Law Office may retain an electronic copy of the draft/final document and related intake for its records but has no obligation to maintain these records beyond its standard retention schedule.
9. Communications and Privacy (SMS/Email/Phone)
9.1 Consent to contact. By responding with the promotion keyword (or by checking the consent box on the website), the Client consents to be contacted by the Law Office via SMS, email, or phone regarding the request and onboarding.
9.2 Text messages (marketing & informational). The Client expressly consents to receive text messages from the Law Office at the mobile number provided, which may include reminders, updates, and occasional marketing or educational content related to probate, estate planning, or other legal services.

Consent is not a condition of any service.
Consent remains until revoked by replying STOP or by written notice.
9.3 Automated technology & records. Messages may be sent using automated technology. The Law Office maintains records of consent and honors applicable federal and Florida Do-Not-Call rules and quiet-hour restrictions for marketing texts/calls.
9.4 Privacy Policy. The Client acknowledges availability of the Law Officeโs Privacy Policy describing data collection, use, and retention practices.
10. General Terms
10.1 Attorney advertising; no guarantee. This promotion may constitute attorney advertising. Prior results do not guarantee a similar outcome.
10.2 No legal advice; no reliance. The Simple Will is a form prepared from Client inputs. The Law Office does not advise whether the Simple Will is suitable for the Clientโs circumstances unless and until the Client retains the Law Office under a separate signed engagement for paid legal services.
10.3 Governing law & venue. These terms are governed by Florida law.
10.4 Entire agreement; modification. These terms are the entire agreement for the free Simple Will scrivener service and may be modified only in writing by the Law Office.
10.5 Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
10.6 Headings. Headings are for convenience only and do not affect interpretation.
